TravelSOUL Terms and Conditions of Use

Welcome to TravelSOUL’s Terms and Conditions of Use (these "Terms"). We want to set some app user behavior so we all can enjoy the app. This is a contract between you and the TravelSOUL, Inc. (as defined further below) and we want you to know yours and our rights before you use the TravelSOUL application ("App"). Please take a few moments to read these Terms before enjoying the App, because once you access, view or use the App, you are going to be legally bound by these Terms

1. TravelSOUL RULES

Before you can use our awesome App, you will need to register for an account ("Account"). In order to create an Account you must:

  1. be at least 18 years old; and

  2. be legally permitted to use the App by the laws of your home country.

You can create an Account via manual registration, or by using your Google account login details. For more information about what information we use and how we use it, please check out our Privacy Policy.

If you feel the need to leave the TravelSOUL community on the App, you can delete your Account at any time by emailing TravelSOUL at info@travelsoulapp.com and requesting your account be deleted. Your Account will be deleted immediately but it may take a little while for Your Content (defined below) to be completely removed from the App. We reserve the right at our sole discretion to terminate or suspend any Account, or make use of any operational, technological, legal or other means available to enforce the Terms (including without limitation blocking specific IP addresses), at any time without liability and without the need to give you prior notice.

You may not access, tamper with, or use non-public areas of the App or our systems. Certain portions of the App may not be accessible if you have not registered for an Account.

2. TYPES OF CONTENT

There are three types of content that you will be able to access on the App:

  1. content that you upload and provide ("Your Content");

  2. content that members provide ("Member Content"); and

  3. content that TravelSOUL provides ("Our Content").

There is certain content we can't allow on the TravelSOUL App:

We want our users to be able express themselves as much as possible, but we have to impose restrictions on certain content which:

  • contains language or imagery which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person;

  • is obscene, pornographic, violent or otherwise may offend human dignity;

  • is abusive, insulting or threatening, discriminatory or which promotes or encourages racism, sexism, hatred or bigotry;

  • encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offence;

  • is defamatory or libelous;

  • relates to commercial activities (including, without limitation, sales, competitions and advertising, links to other websites or premium line telephone numbers);

  • involves the transmission of "junk" mail or "spam";

  • contains any spy ware, adware, viruses, corrupt files, worm programs or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Bumble or otherwise;

  • itself, or the posting of which, infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights);

  • shows another person which was created or distributed without that person’s consent.

TravelSOUL operates a zero-tolerance policy for this kind of content.

Your Content

As Your Content is unique, you are responsible and liable for Your Content and will indemnify, defend, release, and hold us harmless from any claims made in connection with Your Content.

You may not display any personal contact or banking information on your individual profile page whether in relation to you or any other person (for example, names, home addresses or postcodes, telephone numbers, email addresses, URLs, credit/debit card or other banking details). If you do choose to reveal any personal information about yourself to other users, whether via email or otherwise, it is at your own risk. We encourage you to use the same caution in disclosing details about yourself to third parties online as you would under any other circumstances.

As the TravelSOUL App is a public community, Your Content will be visible to other users of the App all around the world instantly - so make sure you are comfortable sharing Your Content before you post. As such, you agree that Your Content may be viewed by other users and any person visiting, participating in or who is sent a link to the App (e.g. individuals who receive a link to a user’s profile or shared content from other TravelSOUL App Users). By uploading Your Content on TravelSOUL, you represent and warrant to us that you have all necessary rights and licenses to do so, and automatically grant us a non-exclusive, royalty free, perpetual, worldwide license to use Your Content in any way (including, without limitation, editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, incorporating into other works, advertising, distributing and otherwise making available to the general public such Content, whether in whole or in part and in any format or medium currently known or developed in the future).

We may assign and/or sub-licence the above license to our affiliates and successors without any further approval by you.

We have the right to remove, edit, limit or block access to any of Your Content at any time, and we have no obligation to display or review Your Content.

Member Content

Other members of TravelSOUL will also share content via the App. Member Content belongs to the user who posted the content and is stored on our servers and displayed via the App at the direction of the user providing the Member Content.

You do not have any rights in relation to other users' Member Content, and you may only use other TravelSOUL users' personal information to the extent that your use of it matches TravelSOUL’s purpose of allowing people to meet one another. You may not use other users' information for commercial purposes, to spam, to harass, or to make unlawful threats. We reserve the right to terminate your Account if you misuse other users' information.

Our Content

You may be wondering what happens to the rest of the Content on the TravelSOUL App. Any other text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, and other intellectual property appearing on TravelSOUL are owned, controlled or licensed by us and are protected by copyright, trademark and other intellectual property law rights. All right, title and interest in and to Our Content remains with us at all times.

We grant you a non-exclusive, limited, personal, non-transferable, revocable, license to access and use Our Content, without the right to sublicense, under the following conditions:

  1. you shall not use, sell, modify, or distribute Our Content except as permitted by the functionality of the App;

  2. you shall not use our name in metatags, keywords and/or hidden text;

  3. you shall not create derivative works from Our Content or commercially exploit Our Content, in whole or in part, in any way; and

  4. you shall use Our Content for lawful purposes only.

We reserve all other rights.

3. RESTRICTIONS ON THE APP

You agree to:

  • comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, equal opportunity laws and regulatory requirements;

  • use your real name on your profile;

  • use the services in a professional manner.

You agree that you will not:

  • act in an unlawful or unprofessional manner including being dishonest, abusive or discriminatory;

  • misrepresent your identity, your current or previous positions, qualifications or affiliations with a person or entity;

  • disclose information that you do not have the consent to disclose;

  • create or operate a pyramid scheme, fraud or other similar practice.

We do not tolerate users misbehaving in the TravelSOUL community – users should not do bad things to other users. Therefore, you can report any abuse or complain about Member Content by contacting us at info@travelsoulapp.com, outlining the abuse and/or complaint. You can also report a user directly from a profile or in chat by clicking the ‘Flag’ icon.

Also, we don't appreciate users doing bad things to TravelSOUL, so scraping or replicating any part of the App without our prior consent is expressly prohibited. This includes by any means (automated or otherwise) other than through our currently available, published interfaces - unless you have been specifically allowed to do so in a separate agreement with us.

4. PRIVACY

For information about how TravelSOUL, Inc. collects, uses, and shares your personal data, please check out our Privacy Policy. By using TravelSOUL, you agree that we can use such data in accordance with our Privacy Policy.

5. NOTIFICATIONS; LOCATION-BASED FEATURES

We may provide you with emails, text messages, push notifications, alerts and other messages related to the App and/or the TravelSOUL services, such as enhancements, offers, products, events, and other promotions. At the time you verify your email account, you agree to receive such notifications mentioned above. If you no longer wish to receive notifications/alerts from the TravelSOUL, you may opt out by emailing TravelSOUL at info@travelsoulapp.com with your request to not receive further notifications

 

The App may allow access to or make available opportunities for you to view certain content and receive other products, services and/or other materials based on your location. To make these opportunities available to you, the App will determine your location using one or more reference points, such as GPS, Bluetooth and/or software within your mobile device. If you have set your mobile device to disable GPS, Bluetooth or other location determining software or do not authorize the App to access your location data, you will not be able to access such location-specific content, products, services and materials. For more about how the App uses and retains your information, please read the Privacy Policy.

6. DISCLAIMER

THE APP, SITE, OUR CONTENT, AND MEMBER CONTENT ARE ALL PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

SHOULD APPLICABLE LAW NOT PERMIT THE FOREGOING EXCLUSION OF EXPRESS OR IMPLIED WARRANTIES, THEN WE GRANT THE MINIMUM EXPRESS OR IMPLIED WARRANTY REQUIRED BY APPLICABLE LAW. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS SECTION.

ADDITIONALLY, WE DO NOT MAKE ANY WARRANTIES THAT THE APP OR SITE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE OR THAT YOUR USE OF THE APP OR SITE WILL MEET YOUR EXPECTATIONS, OR THAT THE APP, SITE, OUR CONTENT, ANY MEMBER CONTENT, OR ANY PORTION THEREOF, IS CORRECT, ACCURATE, OR RELIABLE. YOUR USE OF THE APP OR SITE IS AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. TRAVELSOUL, INC. IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER. TRAVELSOUL, INC. DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS.

NEITHER US NOR ANY OWNER WILL BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INCOME, PROFIT OR GOODWILL, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES ARISING OUT OF YOUR ACCESS TO OR USE OF THE APP, SITE, OUR CONTENT, OR ANY MEMBER CONTENT, HOWEVER CAUSED, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PROPRIETARY RIGHTS INFRINGEMENT, PRODUCT LIABILITY OR OTHERWISE.

THE FOREGOING SHALL APPLY EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU BECOME DISSATISFIED IN ANY WAY WITH THE APP OR SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP YOUR USE OF THE APP AND SITE.

YOU HEREBY WAIVE ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE APP OR SITE. BECAUSE SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES, THESE PROVISIONS MAY NOT APPLY TO YOU. IF ANY PORTION OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN OUR AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THE LIMITATION OF LIABILITY HEREIN IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN AND REFLECTS A FAIR ALLOCATION OF RISK. THE APP AND SITE WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS AND YOU AGREE THAT THE LIMITATIONS AND EXCLUSIONS OF LIABILITY, DISCLAIMERS AND EXCLUSIVE REMEDIES SPECIFIED HEREIN WILL SURVIVE EVEN IF FOUND TO HAVE FAILED IN THEIR ESSENTIAL PURPOSE.

7. INDEMNITY

All the actions you make and information you post on TravelSOUL remain your responsibility. Therefore, you agree to indemnify, defend, release, and hold us, and our partners, licencors, affiliates, contractors, officers, directors, employees, representatives and agents, harmless, from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with:

  1. any negligent acts, omissions or willful misconduct by you;

  2. your access to and use of the App;

  3. the uploading or submission of Content to the App by you;

  4. any breach of these Terms by you; and/or

  5. your violation of any law or of any rights of any third party

We retain the exclusive right to settle, compromise and pay any and all claims or causes of action which are brought against us without your prior consent. If we ask, you will co-operate fully and reasonably as required by us in the defense of any relevant claim.

8. MISCELLANEOUS

These Terms, which we may amend from time to time, constitute the entire agreement between you and TravelSOUL, Inc. The Terms supersede all previous agreements, representations and arrangements between us (written or oral). Nothing in this clause shall limit or exclude any liability for fraudulent misrepresentation.

TravelSOUL, Inc. has taken reasonable steps to ensure the currency, availability, correctness and completeness of the information contained on TravelSOUL and provides that information on an "as is", "as available" basis. TravelSOUL, Inc. does not give or make any warranty or representation of any kind about the information contained on TravelSOUL, whether express or implied. Use of TravelSOUL and the materials available on it is at your sole risk. TravelSOUL, INc. cannot be held responsible for any loss arising from the transmission, use of data, or inaccurate User Content.

You are responsible for taking all necessary precautions to ensure that any material you may obtain from TravelSOUL is free of viruses or other harmful components. You accept that TravelSOUL will not be provided uninterrupted or error free, that defects may not be corrected or that TravelSOUL, Inc., or the server that makes it available, are free of viruses or bugs, spyware, Trojan horse or any similar malicious software. TravelSOUL, Inc. is not responsible for any damage to your computer hardware, computer software, or other equipment or technology including, but without limitation damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other technical or other malfunction.

As TravelSOUL grows, we might have to make changes to these Terms so we reserve the right to modify, amend or change the Terms at any time (a "Change"). If we do this then the Changes will be posted on this page and we will indicate the Effective Date of the updates at the bottom of the Terms. In certain circumstances, we may send an email to you notifying you of a Change. You should regularly check this page for notice of any Changes – we want our users to be as informed as possible.

Your continued use of TravelSOUL following any Change constitutes your acceptance of the Change and you will be legally bound by the new updated Terms. If you do not accept any Changes to the Terms, you should stop using TravelSOUL immediately.

If, for any reason, any of the Terms are declared illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remainder of the Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

No failure or delay in exercising any right, power or privilege under the Terms shall operate as a waiver of such right or acceptance of any variation of the Terms and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of the right or the exercise of any other right, power or privilege.

You represent and warrant that:

  1. you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and

  2. you are not listed on any U.S. Government list of prohibited or restricted parties.

By using the App, you agree and acknowledge that TravelSOUL is a global app operating through servers located in a number of countries around the world, including the United States. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on TravelSOUL, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.

The App may contain links to third-party websites or resources. In such cases, you acknowledge and agree that we are not responsible or liable for:

  1. the availability or accuracy of such websites or resources; or

  2. the content, products, or services on or available from such websites or resources.

Links to such websites or resources do not imply any endorsement. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. Framing, in-line linking or other methods of association with the App are expressly prohibited without first obtaining our prior written approval.

These Terms, and any rights and licenses granted here under, may not be transferred or assigned by you, but may be assigned by us without restriction.

12. ABOUT US

Your access to the App, Our Content, and any Member Content, as well as these Terms are governed and interpreted by the laws of the State of Delaware, other than such laws, rules, regulations and case law that would result in the application of the laws of a jurisdiction other than the State of New York. By using the App, you are consenting to the exclusive jurisdiction of the courts of the United States and the State of Delaware. You agree that such courts shall have in person am jurisdiction and venue and waive any objection based on inconvenient forum. You agree that you will not file or participate in a class action against us. In the event there is a discrepancy between this English language version and any translated copies of the Terms, the English version shall prevail.

The Terms constitute a binding legal agreement between you as user (“you”) and TravelSOUL, Inc. (“we” or “us”). TravelSOUL, Inc. includes the TravelSOUL App (a United States company whose registered office is at 707 Main Street #147, Nashville, TN 37206).

PRIVACY POLICY

Introduction

TravelSOUL, Inc. (referred to as “we,” “us,” “our” or the “Company”) respects your privacy and is committed to protecting it through our compliance with this policy. This privacy notice (“Privacy Notice”) describes the types of information we may collect or that you may provide when you purchase, download, install, register with, access, or use TravelSOUL App (the “App”), as well as our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Notice applies only to information we collect in the App and in email, text, and other electronic communications sent through or in connection with the App. This Privacy Notice does not apply to information that: (i) we collect offline or through any other means, including any other apps or websites that we may own or operate, including any third party websites you may access through the App; or (ii) you provide to or is collected by any third party (see “Third-Party Information Collection” section below). Other websites and apps are subject to their own privacy policies, which you should read before providing information on or through them.

Please read this ENTIRE Privacy Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, ACCESS, or use the App. This Privacy Notice may change from time to time (see “Changes to This Privacy Notice” SECTION BELOW).

Privacy Permissions Requested by the App

In order to provide the services that you request through the App, we also request your permission to collect sensitive information from you, such as access to photos or the microphone on your phone, or access to your phone's geolocation functionality.

Photos and Camera

If you give us permission to access your photos or camera, we will only access them when you specifically choose to share your photos with us and their associated metadata, such as their file types and sizes. We will never scan or import your photo library or camera roll without authorization.  This functionality is used for accessing camera or capturing images from the device.  Users can grant us permission to capture or import the user’s selfies in order to make them available to be viewed by users within the App.

Phone

If you give us permission to access your phone, we will only access it for telephony features, which may include, for example, read only access to phone state, including the phone number of the device, current cellular network information, the status of any ongoing calls, and a list of any phone accounts registered on the device. This, more specifically, allows the App to play audio and be muted when a phone call is incoming.

Microphone

Microphone permissions are required to play audio through the App. You can always disable the microphone permission on your device if you prefer not to make use of these features. The App will still otherwise work without having microphone permission for recording. Please refer to your manufacturer’s device manual for details on how to disable microphone permission.

Geolocation

We may use GPS or similar technology available on your device to determine the city where you are located or expect to travel and allow you to share your location and travel plans with other users of the App  We will not share your precise, real-time location with other users or partners except to the extent that you share your city location.  If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the App located in your account settings or in your mobile phone settings and/or within the App.

If, at any time you wish to access, modify, grant, or remove permissions, you may do so using your device settings to enable or disable any features related to those permissions.  The above permission requests are limited to the critical information necessary to implement the App.

Changes to This Privacy Notice

The Company reserves the right, in its sole discretion, to update, change, modify, add or remove portions of this Privacy Notice from time to time. If we make material changes to how we treat our users’ personal information, we will post the new Privacy Notice on this page with a notice that the Privacy Notice has been updated and notify you by email to the email address specified in your account or an in-App alert the first time you use the App after we make the change. You are responsible for ensuring we have an up-to-date active and deliverable email address for you. Any changes to this Privacy Notice will be in effect as of the “Last Modified” date referenced in this Privacy Notice.  You are expected to, and you acknowledge and agree that it is your responsibility to, carefully review this Privacy Notice prior to using the App and from time to time so you are aware of any changes.

Children Under the Age of 18

The App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the App or provide any information about yourself to us, including your name, telephone number, email address or any screen name or user name you may use.  If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at info@travelsoulapp.com.

Information We Collect and How We Collect It

We collect information from and about users of our App directly from you when you provide it to us and automatically when you use the App.

 

Information You Provide to Us

When you download, register with, or use the App, we may ask you to provide information by which you may be personally identified, such as name (first and last), gender, email address, age range, hometown, Personal Interests (Sporting events, exercise, LGBTQ Travel, Night life, meeting locals, Fine Arts & Culture, Live Music, Outdoor Activity, Food & Drink), and/or any other identifier by which you may be contacted online or offline so that you may use the App and we may properly support your use of the App (“personal information”). We may also collect information that is about you but individually does not identify you, including, but not limited to:

  • Information that you provide by filling in and submitting forms in the App. This includes information provided at the time of registering to use the App, subscribing to our service, posting material, and requesting other services. We may also ask you for information when you report a problem with the App.

  • Records and copies of your correspondence (including email addresses and phone numbers) with us, if any.

  • Details of transactions you carry out through the App.

  • When enabled by you, push notifications are used to send App messages to your device even when the App is not running.

 

Other than as described above, we do not seek any other access to your mobile device or its phonebook, contact data, microphone, or camera.

Information Collected and Used When Using Our Social Features

Your user account may include social features that permit you to share text and images with other users of the App. Such content can be deleted at any time by you. Content shared via these features will only be viewable to users with whom you have specifically connected and allowed such access. Otherwise, by default, other users of the App will be able to view your display name and profile details if you share common personal or travel interests.  Such details may include: username (usually your first name and last name), profile picture (uploaded by user), age range, hometown, and Personal Interests (Sporting events, exercise, LGBTQ Travel, Night life, meeting locals, Fine Arts & Culture, Live Music, Outdoor Activity, Food & Drink). 



Automatic Information Collection and Tracking

When you download, access, and use the App, it may use technology to automatically collect:

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App. This includes how you communicate with other App users, such as their usernames, the time and date of your communications, the number of messages you exchange with your friends, which friends you exchange messages with the most, and your interactions with messages (such as when you open a message).

  • Content Information. We collect content you create on our services and information about the content you create or provide, such as if the recipient has viewed the content and the metadata that is provided with the content.

  • Mobile Device Information. We collect information from and about the devices you use. For example, we may collect: information about your hardware and software, such as the hardware model, operating system version, unique application identifiers, unique device identifiers, browser type, language, and time zone; information from device sensors, such as microphones; and information about your wireless and mobile network connections, such as mobile phone number, service provider, and signal strength.

  • Camera and Photos. Many of our services require us to collect images and other information from your device’s camera and photos. For example, you won’t be able to send Snaps or upload photos from your camera roll unless we can access your camera or photos.

  • Location Information. When you use the App, we collect real-time information about the location of your mobile device.  With your consent, this may include: your precise location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points, and other sensors.

  • Log Information. We also collect log information when you use our website. That information includes, among other things: details about how you’ve used our services, device information, such as your web browser type and language, access times, pages viewed, IP address, identifiers associated with cookies or other technologies that may uniquely identify your device or browser, and pages you visited before or after navigating to our website.

If you do not want us to collect this information, do not download the App or delete it from your mobile device. We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking). “Do Not Track” is a proposed standard that is currently under development. As it is not yet finalized, we adhere to the standards set out in this Privacy Notice and we do not currently respond to “Do Not Track” signals in the App.  The information we collect automatically is statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties.

Information Collection and Tracking Technologies

At this time, the App does not use third party analytics or advertising.  If this changes, we will post an update here describing any changes and ask you to consent to them. 

 

Third-Party Information Collection

When you access or use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your mobile device. These third parties may include:

  • Your mobile device manufacturer.

  • Your mobile service provider.

These third parties may use tracking technologies to collect information about you when you access or use the App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about any technologies in use, you should contact the responsible provider directly. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Administer, operate, protect, and maintain the App and its contents, and any other information, products or services that you request from us.

  • Fulfill any other purpose for which you provide it.

  • To help personalize your experience.

  • Give you notices about your account, including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us.

  • Respond to inquiries and requests from you and to provide you with information and access to resources that you have requested.

  • Analyze and aggregate your and use of the Website, Apps or Services for trend monitoring purposes.

  • Send you technical alerts, updates, security notifications, and administrative communications.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences.

  • Recognize you when you use the App.

We use location information we collect as part of your consent agreement.

We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. We may disclose aggregated information about our users, and information that does not identify any individual or mobile device, without restriction. In addition, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our App users is among the assets transferred.

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of the App may then be inaccessible or not function properly.

  • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your mobile device’s location through the device’s privacy settings or the App’s settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly.

  • Promotion by the Company. If you do not want us to use your contact information to promote our own or third parties’ products or services, you can opt-out by contacting us at info@travelsoulapp.com to make this request.

  • Device Opt-out Options.  Your device may provide options to opt-out of receiving advertisements or to limit ad tracking.  Please refer to your device’s settings to determine the opt-out options available for your device.

How Long Do We Store Your Personal Information?

We will retain your personal information for as long as needed to fulfill the purposes for which it was collected.  We also will retain and use your personal information as long as necessary to comply with our business requirements, legal obligations, resolve disputes, protect our assets, provide our services, and enforce our agreements. When we no longer have a purpose to retain your personal information, or upon your request, we will securely destroy your personal information in accordance with our security practices and applicable law.

 

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls hosted on Amazon Web Services. Your personal information is password protected and restricted within our organization to employees and trusted partners that need access to your personal information in order to correspond with you and provide the products and/or services that you requested from us. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to the App, you are responsible for keeping this password confidential. Do not share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Linked Apps and Websites

This Privacy Notice is applicable only to the App and does not apply to any third-party apps or websites.  The App may contain links to, and media and other content from, other apps and websites.  In addition, such third-party media and content may also contain external links.  Because of the dynamic media capabilities of the App, it may not be clear to you which links are embedded in the App and which are embedded in third-party media and/or content.  The Company cannot and does not guarantee the privacy policies and practices of any third party.  The Company does not control, operate, or endorse any information, products, or services of any third-party apps or websites that may be reached through links from the App.  The Company is providing these links only as a convenience to you.

The use of any personal information provided by you to, or automatically collected from, a third party will be governed by that party's privacy policies.  If you are unsure whether an app or website is controlled, affiliated, or managed by the Company, you should review the privacy policies at each linked app or website to determine how that site treats your personal information.

Accessing and Correcting Your Personal Information

You can change your password by logging into the App and visiting your account profile page. If you need to delete your account or if you have any questions about, or need to change, any other personal information that may be retained by the Company, you may also contact us at info@travelsoulapp.com. The Company will use commercially reasonable efforts to ensure that personal information we may be using or disclosing is accurate and complete.  We will use commercially reasonable efforts to respond to any such request and update your personal information, if necessary. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Use During Emergencies

Use of the App during an emergency is not recommended. The App is not intended to support 911 or other emergency communications and any attempt to use the App for such purpose may result in misdirected or incomplete communications.  The App's location data cannot be relied on for emergency communication purposes.  The App is provided "as is" and "as available" solely for the purposes described in this Privacy Notice.

 

Your California Privacy Rights

California Civil Code Section 1798.83 permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us at info@travelsoulapp.com.  Please note, however, that we do not share personal information with third parties for their direct marketing purposes.

Governing Law; Located in the USA

This Privacy Notice and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of New York, exclusive of its choice of law rules. 

Our App and our services are located in the United States and are controlled, operated and administered by TravelSOUL,Inc. from its offices within the United States of America. Please be aware that your information will be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated.
